Rental Aggrement

TERMS OF RENTAL AGREEMENT:


Deposit and Cancellation Policy:
Accidental damage insurance is included in your invoice for $59  –  $69.00. This is non-refundable, applies only to accidental damages. Malicious acts or vandalism are not covered. Your credit card will be pre-authorized (1-2 days prior to arrival) for  $500.00  –  $1,500.00 depending on property you have rented.

Winter cancellations:  In the event of a cancellation, a refund of the monies paid, less 15% of the total lodging expense will be made if notified 90 days or more prior to arrival in writing. Should notification be made less than 90 days prior to arrival, the entire amount paid could be subject to forfeiture and will be considered on a case by case basis. We will work to re-rent the property.   If the property is fully re-rented a refund will be made less the cancellation charge of 15% of the rental fee.

 No cancellations between April-Oct.   if you have to cancel, and we are able to re- rent the property we will refund your money less 15% of the amount paid.

The Pre-Authorization amount   will be refunded if following provisions are met:

  1. No Damage is done to the property or it’s contents.
  2. No linens or household items are missing.
  3. No early check-in or late check-out (without consent of Rental agent).
  4. House or Garage has not been smoked in.
  5. Excessive cleaning.  No Oil spots in Driveway.
  6. Any action that requires the police to come to Rental Home may result in loss of pre-authorization hold.

After your stay, we will closely examine the premises for damages and we will return your pre-authorization deposit, less any charges for damages within 15 days. If the damage deposit is insufficient to cover all damages caused during your stay, then we reserve the right to collect additional funds to cover the balance of the damages. If it becomes necessary to institute collection proceedings, then we are also entitled to collect reasonable attorney’s fees and court costs. For the purpose of this agreement, the term “damage” includes, but is not necessarily limited to the following: Physically damaged personal and real property, missing or stolen items, extraordinary utility usage, other damage not considered normal wear and tear.

PAYMENT OF DATES RESERVED.
The guest is responsible for the payment of all night’s reserved regardless of the guest’s actual arrival and departure date.

DEPOSITS.
All funds paid, including security deposits, shall be held in an interest bearing Arizona depository trust account, payable to Integrity Arizona Real Estate Sales (Vacation Rentals) If any interest is earned, it is for the benefit of Integrity Arizona Real Estate Sales (Vacation Rental.)

CHECK-IN/CHECK-OUT TIMES.
Check-in 4:00 p.m. Check-out 11:00 a.m. We ask that exceptions not be requested as these times allow the
necessary time to professionally clean the property. A $200 charge will be incurred should you stay beyond this time. Late check-outs and early check- ins may be arranged in advance (if availability Check with agent for pricing. Please confirm in advance with your agent.

PETS
Pets will be considered but are usually not allowed in any home or condominium. For those properties that will accept a pet, a   $200.00   per pet fee is charged.

SMOKING  
Is not permitted in any of our homes or condo’s, You will forfeit your deposit in full, if you smoke inside  our homes or condo’s. If you or your guest smoke, we expect it to be done away from any entry doors. Furthermore, we expect that cigarette butts will be properly disposed of. It will be expensive for you to carelessly disregard the no smoking rule in terms of extraordinary cleaning and/ or paint.

PROPERTY KEYS and GARAGE REMOTES.
Each property is keyed individually. There will be a  $25.00 charge for each of the keys not returned (1).
Should new locks need to be installed, renter shall be responsible for all charges and additional keys required in this unlikely event. The lock box must have the original key placed in It at departure. Failure to do so will result in additional charges. Garage remotes to be left on Kitchen counter. Misplaced Garage door openers, will incur a   $100.00   replacement fee. Kings View Condo’s Beach Gate/ Pool Gate key is   $100.00   replacement fee.

HOME/CONDOMINIUM DISCLOSURE
It is expressly understood and agreed that the Owners of property, Agents and Brokers and Property management of Integrity Arizona Real Estate Sales LLC   shall not be liable for damages or injury to the guest, invitees of the guest, of guest’s property for whatever cause arising from the occupancy of said property by the registered guest.

ENTRY OF PREMISES.
Authorized repairmen or employees may enter the premises as necessary, for the purpose of repair, improvement, housekeeping and management of the property. Random security checks  may be  performed as needed to ensure property is not exceeding maximum stated occupancy. The condominium or home you have rented may be listed for sale at any time. There is always the possibility that you will be contacted to request a convenient time for a showing.  AGE REQUIREMENTS. You must be over the age of 25 to rent and secure a property. The entire party must also be of this age unless there are children to whom you are related or who share in familial status.

POOLS AND SPA. (If home has a Hot tub, Spa and/or  Pool) The pool and spa are not secured with it’s own fencing, Therefore all guest that use the pool and spa or Hot tub at their own risk. Parents or guardians of small children under the age of 18 acknowledge this fact and take full responsibility for minors and hold harmless the Owners of property, Agents and Brokers and Property Management of Integrity Arizona Real  Estate Sales LLC. In case of accidental drowning and or injury sustained.

POOL & HOT TUB, SPA PROPANE/GAS OR ELECTRIC USE
Propane reading will be taken prior to arrival. Any propane used will be taken out of your Damage deposit. Every 5% used equals   $50.00.
Pools heated by Natural Gas homes are   $50.00   per day for under 30 day stay the guest pays the entire month gas bill. (Tee, Paseo Dorado,Manzanita, Palmer, Rover, Demaret, Rainbow. Saratoga is $60 per day

UTILITIES FOR MONTHLY RENTALS:
Utility cap includes electric, water and gas used in home (not gas for pool)  Individual homes have varied  rates.

HOUSEKEEPING.
Pool towels belong and are the personal property of each individual owner. Do not take them off the property. All properties are equipped with linens/towels.  Please have dishes cleaned upon your departure, charges will be incurred for any extra housekeeping required. dirty towels and linens to be place in laundry rooms.

COURT VENUE: If any Court proceeding are instituted due to this occupancy or any aspect of the Rental Agreement, it is hereby agreed that the proper venue for those proceedings will be in Mohave County, Lake Havasu Division
LOCAL LAW AND ORDINANCES;
Please respect the neighbor’s and have consideration for them. They aren’t on VACATION.”
I (we) our guests and visitors, agree that any drug use on the property, or any disturbance, annoyance,
endanger, or inconvenience of the neighbors, or use of  the premises for any immoral or unlawful purpose, or violate any law or ordinance or commit waste or nuisance on or about the premises will immediately terminate our occupancy and rental agreement of the premises. Police being called out to home may result in loss of complete security deposit.  All charges will apply if evicted.

UNFORESEEN CIRCUMSTANCES.
Integrity Arizona Real Estate Sales and Vacation Rentals, a licensed Arizona Real Estate Brokerage is the agent for privately owned homes and condominiums. The nature of this relation is that we cannot completely control the use of the accommodations we manage. Although problems are rarely encountered, we must reserve the right to change accommodations up to and including the day of arrival. In the unlikely event that we are not able to provide accommodations without an increase in rent, the guest will have the option of paying the increase rent, or the reservation will be cancelled and all deposits will be refunded to the guest with no further rights or obligations between Integrity Arizona Real Estate Sales and Vacation Rentals and guest.
This is a contract for rental of the property listed above. The AZ Residential Landlord Tenant Act does not apply.  The Standards of Practice used by Inn Keeper Statues govern this agreement. We may require you vacate at your expense without notice to you, if the property is used in violation of the law of this Agreement.
You agree to indemnify us, defend us and hold us harmless from all claims, liability, costs and attorney fees resulting from, or arising out of, this rental and/or your misuse of the property.  We make no warranties, express, implied or apparent, regarding the home.

I hereby authorize Integrity Arizona RE to charge my credit card on file for charges resulting from damages or loss to the property inventory, damages or loss to the property itself, out of US calls, any need for extra cleaning.
Upon check out guests are to tidy up, and leave the home in same overall condition in which it was found, (cleaning dishes, take out the garbage, no moving of furniture or additional charges will be incurred.)

HOUSE RULES & SPECIAL INSTRUCTIONS:
Check-in Time:4:00 P.M.  Check-out Time:  11:00 A.M.

  • No Smoking In the House or In the Garage
  • Remove all trash and recycling from inside the home and place it in the appropriate blue bins then take to the street for pick-up. Kings View/Nautical Estate Condo put in dumpster
  • Remove all YOUR food and beverages from the refrigerator and cabinets before departing the home.
  • Make sure you have removed any garage door openers from your vehicle and placed them on the counter top in the kitchen before vacating the property. Please put one key back into Lockbox before leaving, leave the other on counter with remote.
  • There is a   $100.00   fee to replace lost or misplaced remotes.  $25.00 replacement for Keys.
  • Kings view and Nautical Estate condo beach/pool key for gate is   $100.00
  • Turn out all lights, heater, T.V’s, before you depart from the property.
  • Set Air conditioner at 85 degrees. During summer months. Turn off heater in winter.
  • Make sure all exterior doors and windows are locked before you vacate the property.
  • House Keeping will arrive on site around 11:00 A.M.
  • One of our staff will enter into the unit to evaluate the condition of the unit within 24 hours of your departure
  • No pets allowed. Unless approved by management.  You are responsible for the propane that heats the pool/Spa. So take care not to forget to turn off heater/ propane tank. The cost will come out of your deposit. Please be respectful of the neighbors and quite after 10:00 p.m.
